Trump Administration Has Refunded About $100 Billion in Tariffs Struck Down by Supreme Court

US Customs and Border Protection (CBP) disclosed in a court filing submitted Tuesday, 20 Mordad 1405 (August 11, 2026), to the US Court of International Trade that it has refunded about $100 billion in tariffs to importers since the Supreme Court ruled against the Trump administration's use of emergency powers to impose the duties. Brandon Lord, CBP's executive director of trade policy and programs, said in the filing that more than three quarters of $128.68 billion in tariff revenue earmarked as "certified or potential refunds" has now been disbursed. The US Supreme Court ruled 6-3 in February 2026 that Trump exceeded his authority by invoking the 1977 International Emergency Economic Powers Act to impose fentanyl-related tariffs on Canada, Mexico and China and broader "reciprocal" tariffs on more than 90 countries. The government had collected about $166 billion from importers before the ruling. The decision left intact tariffs imposed under the 1962 Trade Expansion Act on goods including steel, automobiles and copper. The administration has continued imposing new tariffs since the ruling, announcing 10 to 12.5 percent levies on imports from dozens of countries last month, a move that 25 US states including New York and California challenged in court on Monday.
