US Customs Has Refunded $100 Billion in Tariffs Struck Down by the Supreme Court

According to Al Jazeera, in a report published Friday, August 14, 2026 (23 Mordad 1405), the US Customs and Border Protection agency (CBP) disclosed in a Tuesday court filing with the US Court of International Trade that it has refunded more than three quarters of the $128.68 billion in tariff revenue identified as certified and potential refunds, a figure of nearly $100 billion. Brandon Lord, CBP's executive director of trade policy and programs, said in the filing that the agency's accounting system regularly receives updates from the Treasury showing the certified refunds are being distributed.

The refunds began after the US Supreme Court ruled 6 to 3 in February 2026 that President Trump exceeded his authority by invoking the 1977 International Emergency Economic Powers Act (IEEPA) to impose tariffs on Canada, Mexico, China and more than 90 other countries. The ruling did not strike down tariffs imposed under the 1962 Trade Expansion Act, including those on steel, automobiles and copper. The US Court of International Trade separately ruled in March that companies affected by the invalidated tariffs should be reimbursed.
